These Terms of Service (“Terms”) are an agreement between you and Fria (“we”, “us”, or “our”) governing your use of the Focavio mobile application and this website (together, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility
You must be at least 13 years old, or the minimum age of digital consent in your country, to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian. By using the Service, you confirm that you meet these requirements.
2. License to use
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, and revocable license to download and use Focavio for your own non-commercial purposes on devices you own or control. This license is also subject to the Apple App Store Terms of Service, including the Licensed Application End User License Agreement, where applicable.
3. Subscriptions & purchases
Focavio offers optional paid features through Focavio Pro, available as a subscription or one-time purchase. The following apply to all purchases:
- Prices, billing periods, and features are shown in the app at the time of purchase.
- Payment is charged to your Apple account upon confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- You can manage or cancel a subscription, and turn off auto-renewal, in your Apple account settings.
- Except where required by law, payments are non-refundable. Refund requests are handled by Apple under its policies.
- A one-time (“lifetime”) purchase grants access for the lifetime of the app and does not auto-renew.
4. Acceptable use
You agree not to:
- Copy, modify, reverse-engineer, decompile, or attempt to extract the source code of the Service, except to the extent permitted by law;
- Resell, sublicense, or commercially exploit the Service or any part of it;
- Circumvent, disable, or interfere with security or access-control features, including those related to purchases;
- Use the Service in any way that is unlawful, or that could harm, disable, or impair it or its underlying infrastructure.
5. Focus & app-blocking features
Focavio includes tools intended to help you reduce distractions, such as limiting access to selected apps during a focus session. These features are aids to support your own focus habits; they are not a guarantee that you will avoid every distraction, and they are not a substitute for professional advice on health, productivity, or wellbeing. You remain responsible for your own use of your device, including ensuring you can access anything you need for safety or emergencies.
6. Intellectual property
The Service, including its software, design, text, graphics, logos, and the Focavio name, is owned by Fria or its licensors and is protected by intellectual-property laws. Except for the limited license granted above, these Terms do not transfer any right, title, or interest in the Service to you. The data you create through your use of the app, such as your focus history, remains yours.
7. Third-party services
The Service relies on third-party providers, including Apple for app distribution and payments, and infrastructure providers for cloud backup and subscription management. Your use of those services may be subject to their own terms and policies. We are not responsible for the practices of third parties.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data will always be available or accurately preserved. You are responsible for keeping your own backups of important information where possible.
9. Limitation of liability
To the maximum extent permitted by law, Fria and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or USD $20. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
10. Termination
You may stop using the Service at any time and delete the app. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination — including intellectual property, disclaimers, and limitation of liability — will continue to apply.
11. Changes to the Service & Terms
We may update, change, or discontinue all or part of the Service, and we may revise these Terms from time to time. When we make material changes to these Terms, we will update the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-laws principles, and subject to any mandatory consumer-protection rights you have where you live. Nothing in these Terms limits rights that cannot be limited under applicable law.
